I've got a fenced property.
I really dont see a need to fence a pond or a pool, unless you WANT too.
If a three year old kid cant swim, his parents should be neutered.
If a two year old escapes the parents and gets in the area, the parent should be shot.

No fence here, like Doug, fenced property, just have to worry about the hens flying in and my Gson is only in the backyard when we are, ALL them time.
A child can drown in a 12" deep water garden, or even less. If a wandering child is a concern, then the pond needs to be fenced no matter how deep or shallow it is. My whole property is fenced and I live in the country....no neighbors with wandering kids. As soon as my children start cranking out the grandkids though, the pond will be fenced. I will also use an electric wire on top so no one can climb the fence.
My pond is in the back yard and here in Virginia Beach if you have a pool or pond they have to be fenced in.It's the city code.

I don't have a fence around my pond, but of course I live way out in the country. My 4 grandchildren are not left out alone when they come visit. I am always with them. There is not a easy access to the pond edge due to plantings except in one area which I have a low splitrail cedar partition. I have a ledge around the pond that any animal can easily get out. I cover the pond in winter so I don't have to worry about thin ice.
Young children can drown in a few inches of water and it pays to be diligent at all times. Town people need the fences.

We also have our pond "fenced". It isn't a large gaudy fence, but it is a fence that goes around the perimeter so there is no climbing on the rocks etc. We built our pond in 2003 when our kids were 2 & 5 years old and I couldn't live with myself if they fell in. They are well aware of how deep it is and it is also the first thing we show friends when they come over. We let them view the pond, feed the fish and then give them a run down on the rules. As for kids being able to swim by age 3, I have to disagree...anyone can drown under the right circumstances. My daughter is 4 and she got caught in her floaty this summer in only 6 inches of water (thankfully I am not a parent that just lets them play unsupervised) and she could not get up because her arms and legs were stuck and she would have drowned if we didn't see it happen. I think any time there is a chance of kids being around the pond, it should be fenced in.
I have a tall wood fence around my backyard but it was built for the seclueded feeling that it provides and not as a safty factor for the pond. Obviously the side effect is that it keeps the neighborhood kids from running around my backyard, looking for every loose rock that you can find, to throw into the pond. From a legality issue, I guess I would first check with local codes to see if anything is required, especially if the pond is taking on the look and feel of a pool as far as depth and vertical walls. If no fencing is requried, I follow the blammo belief that parents are responsible for their kids well being and that includes not allowing them to trespass into neighbor's yards.

Backyard is fenced and have locks on all gates. Gates stay locked at all time. If people want to see fish and pond they need come to front door and knock and I will be more than happy to show them. Marc

At one house I put in a pool and the local codes didn't require a fence. I asked my insurance guy if one would help and his answer was that fence or no fence, code or no code, if someone drowns your gettin' sued anyway. Their insurance will sue you.

Our yard has a 6 foot fence, and a self closing safety latch on the gate. City requires a 5 foot fence for any water feature, kiddie pool, ect., that is over 17" deep.

In our county there are open irrigation ditches all throughout the largest local city. No they are not fenced. I'm not sure how much of a chance a toddler would stand if they fell in with the current in them. Now how many report of children drowning in irrigation ditches are in the news all spring/summer/fall? More drownings in the river.
I might fence in my pond with my granddaughter possibly being around. But they don't come this direction very often, they have their own pond to train her on so hopefully it isn't going to be a problem. I do want them to take her to swimming lessons..hmmm maybe that could be a Christmas present??
you might want to fence in any backyard pond because of:
- city/county law
- deed restrictions
- HOA rules
- what your homeowner's insurance will say if something happens and you did not fence in the pond
- what some crazy neighbor and their attourney will do to you (no matter want does or does not happen....)
